1. Introduction
The First Annual Ugly Sweater Bus Ride (“Event”) is organized by Keep DART In Plano (“KDIP,” “we,” “us,” “our”), a 501(c)(4) nonprofit organization. The Event takes place on public transit services operated exclusively by Dallas Area Rapid Transit (DART).
KDIP is not affiliated with, endorsed by, or acting on behalf of DART or the City of Plano.
By signing up through the KDIP website, registering via SquareSpace or Acuity Scheduling, RSVP’ing, or attending the Event in any capacity, participants agree to be bound by these Terms and Conditions.
2. Fare Sponsorship and Ticketing
2.1 KDIP will sponsor the DART fare for the first fifty (50) individuals who register through the official event page on the KDIP website using SquareSpace and/or Acuity Scheduling.
2.2 Sponsored fares are allocated strictly based on the timestamp of completed online registration and will be confirmed via email.
2.3 Participants who do not receive written confirmation of sponsorship must purchase their own valid DART pass through the GoPass app or another official DART system.
2.4 KDIP does not guarantee sponsorship availability and assumes no responsibility for registrations submitted after sponsorship capacity has been reached.
3. Participant Obligations
3.1 Participants must comply with all DART rules, regulations, codes of conduct, and fare requirements.
3.2 Participants must behave safely, respectfully, and lawfully toward other riders, DART staff, and Event participants.
3.3 Participants are solely responsible for their personal safety, actions, and belongings at all times.
4. Minors
4.1 Participants under 18 must have approval by a parent or legal guardian.
4.2 The adult assumes full responsibility for the minor’s actions and safety.
5. Weather, Transit Operations, and Scheduling
5.1 The Event will occur rain or shine.
5.2 All transit scheduling, delays, route changes, or service interruptions are controlled solely by DART.
5.3 KDIP is not liable for delays, disruptions, or inconveniences resulting from DART operations or external events.
6. Accessibility
6.1 DART is fully responsible for ADA accessibility and accommodations.
6.2 Participants needing accessibility accommodations should contact DART directly.
6.3 KDIP does not control or guarantee the availability of accessible vehicles or infrastructure.
7. Assumption of Risk and Liability Waiver
7.1 Participation is voluntary and at the participant’s own risk.
7.2 KDIP does not manage or assume responsibility for the operation, safety, or performance of DART vehicles, facilities, or staff.
7.3 Participants release and discharge KDIP and its directors, officers, volunteers, and representatives from all liability relating to:
personal injury or illness,
accidents,
property damage or loss,
transit delays or disruptions,
or any occurrence connected to participation in the Event.
8. Conduct, Removal, and Safety
8.1 KDIP may remove any participant whose behavior is unsafe, unlawful, disruptive, or inconsistent with these Terms.
8.2 Participants are responsible for any consequences resulting from their conduct.
9. Media and Photography Release
9.1 KDIP may capture photos, videos, or recordings during the Event.
9.2 By registering or attending, participants grant KDIP a non-exclusive, royalty-free, perpetual license to use their image or likeness for promotional or organizational purposes.
9.3 Participants who prefer not to be photographed may notify a KDIP representative.
10. Email Communications and Consent
10.1 Participants may unsubscribe from non-Event communications at any time, but unsubscribing before the Event may prevent the receipt of essential updates.
10.2 By registering for the Event, participants consent to receive email communications from KDIP regarding:
Event updates and reminders,
fare sponsorship confirmations,
logistical details,
safety information,
schedule changes or important alerts.
11. Data Use and Privacy
11.1 KDIP collects registration information solely for Event administration and internal organizational purposes.
11.2 KDIP does not sell or disclose participant information to third parties.
11.3 KDIP may retain anonymized data for internal reporting and operational purposes.
12. Third-Party Platform Terms (SquareSpace & Acuity Scheduling)
12.1 Event registration is processed through third-party platforms including SquareSpace and Acuity Scheduling.
12.2 By registering for the Event, participants acknowledge and agree that they are also subject to the terms of service, privacy policies, data handling practices, and operational rules of these platforms.
12.3 KDIP is not responsible for the operation, security, reliability, or policies of SquareSpace, Acuity Scheduling, or any other registration-related third party.
13. Event Modification or Cancellation
13.1 KDIP may modify, reschedule, or cancel the Event at any time for safety, operational, or organizational reasons.
13.2 KDIP is not responsible for participant costs or inconvenience resulting from such modifications or cancellations.
14. No Affiliation or Agency
Nothing in these Terms shall be construed as creating an endorsement, partnership, or agency relationship between KDIP and DART or the City of Plano. KDIP operates independently.
15. Acceptance of Terms
By signing up through the KDIP website, registering via SquareSpace or Acuity Scheduling, RSVP’ing, or attending the Event, participants confirm that they have read, understood, and agree to be bound by these Terms and Conditions in full.
